YOU'RE GETTING MARRIED! Marriage
is many things. It is an expression of love, a lasting commitment,
a time of celebration...and it is serious business. Like it or not,
there is a business side to marriage. At the conclusion of the wedding
service, while the wedding bells are still tolling, new responsibilities
are placed upon each of the two who have become one.
Legally you
will be responsible for certain of one another's debts (e.g. medical
bills in particular under Virginia law). You will want to be ready
to attend to one another's business affairs in the event of your
spouse's unexpected disability (a Power of Attorney should be in
place for this purpose). Plans should be already made in case you
are called upon to make medical decisions for your spouse (an Advanced
Medical Directive will be important; organ donation decisions should
be discussed and reflected on your driver's license). A change of
insurance beneficiaries should be considered, guardianship issues
for minor children should be decided and documented. Each of you
should have a will prepared in order to spare your spouse from unnecessary
probate expenses (such as a bond and appraisal which are required
unless waived in your will) and to direct your property as you wish
in the event of your death.
Weddings are
serious business. Help yourself and your mate remove uncertainties
in these areas by discussing them with one another and then consulting
with your attorney.
